Vendor Trading Agreement Terms and Conditions

1. Stall Presentation

Stall presentation is crucial to The Nash & Dash Markets' reputation as a high-quality market supporting local makers. Stallholders must present their stalls professionally and creatively, ensuring that their layout reflects their brand story cohesively and represents their products effectively.

The Nash & Dash Markets Management reserves the right to request adjustments to stall displays that do not meet market standards. Stallholders must confine their items, including storage boxes, trolleys, and non-essential equipment, within their allocated stall space and keep them concealed during trading hours. No items are permitted outside the stall boundaries.

Stallholders are responsible for personal and public safety around their stall and must comply with all relevant Australian laws and regulations.

2. Stall Allocation

Stall allocation is at the sole discretion of The Nash & Dash Markets Management. While stallholders will be notified of their stall location in advance, it remains subject to change at any time. Stallholders must trade within the allocated stall boundaries. Relocation from an outdoor to an indoor site due to weather will incur an upgrade fee, which must be requested at least 48 hours before the market.

Approval of a stall does not guarantee future approval, and stalls may be discontinued at The Nash & Dash Markets Management's discretion.

3. Market Cancellation Due to Dangerous & Inclement Weather

The Nash & Dash Markets may cancel a market due to unsafe or extreme weather. Outdoor stallholders must bring their own marquees. In the event of cancellation, no refund will be provided. However, stallholders may roll over their booking to the next available market, with the original pricing honored.

The decision to cancel a market will be based on weather forecasts, council regulations, and BOM weather reports. Once the market begins, no refunds or rescheduling will occur.

4. Payment of Site Fee

All vendors will receive a tax invoice detailing the total fee and payment methods. Payment is due in full no later than 14 days before the market date. Failure to pay by the due date will result in booking cancellation.

5. Marquee Weights and Requirements

Outdoor stallholders must supply their own marquees and secure them with appropriate weights. Improvised weights are not acceptable. Stallholders without proper weights will be unable to trade. Pegging or staking of marquees is strictly prohibited.

Indoor sites are not permitted to have marquees unless requested.

6. Transfer of Ownership

The Nash & Dash Markets may transfer any rights or obligations under this agreement, and will notify the vendor in writing of such transfers, including sale or joint ownership.

7. Bullying and Harassment

Bullying, harassment, or inappropriate behavior, including verbal and online abuse, is strictly prohibited. Any vendor engaging in such behavior will be banned immediately, required to dismantle their stall, and forfeits all fees.

8. Directives

All directives from The Nash & Dash Markets General Manager or authorized personnel must be followed. This includes safety instructions, parking rules, and any changes to stall allocations or activities. Non-compliance may result in the termination of the vendor agreement without a refund.

9. Emergencies

In emergencies, vendors must follow instructions from market management. In the event of an evacuation, vendors and patrons will be guided to pre-designated assembly areas by market crew.

10. Parking

Vendors must comply with local parking restrictions and are responsible for any parking violations. Stallholders must not park in accessible spaces unless authorized. On-site vehicle movement is restricted to 5 km/h, and parking within the market area is prohibited, except for food vendors with assigned bump-in times.

11. Confidentiality Agreement

Both parties agree to treat all confidential information as such and will not disclose or use any information without written permission.

12. Privacy Policy

Vendor personal information will be handled per Australian Privacy Laws. The Nash & Dash Markets may use vendor email, phone numbers, and photographs for promotional purposes and may share public information with venue partners.

13. Permitted Product Lines and Activities

Vendors may only sell approved products and services as outlined in their agreement. Trading outside of approved lines may result in suspension or termination. Product audits will occur regularly.

14. Smoking, Drugs, and Alcohol

The Nash & Dash Markets is a non-smoking environment. Vendors and staff must not be under the influence of drugs or alcohol while on-site. Violation of this rule will result in immediate termination of the vendor agreement without a refund.

15. Weather

The Nash & Dash Markets will provide advance warnings of extreme weather. In the event of adverse weather, market start and end times may change, with no refund provided. Vendors must ensure the market administration has up-to-date contact details for notifications.

16. Housekeeping - Cleaning

Stallholders must maintain cleanliness within and around their stall area. Waste and spillages must be addressed immediately. Pouring grey water or other substances onto grass or trees is prohibited.

17. Housekeeping - Presentation Standards

All stock, signage, and props must remain within stall boundaries and be secured safely. Pedestrian access must be maintained, and no items should block walkways.

18. Stallholder Number

Each stallholder will receive a market-specific stall number, which must be displayed at their stall. Site numbers are allocated by The Nash & Dash Markets Management based on various factors.

19. Amplified Sound

Vendors are not permitted to play amplified sound or un-silenced generators at their stalls. The Nash & Dash Markets will provide live music through local artists.

20. Safety - Fire Safety

Stalls using gas or electricity must have proper fire safety equipment, including a 2 kg dry chemical fire extinguisher. All fire safety equipment must be regularly serviced and compliant with AS 1851:2012.

21. Site Allocation, Power, and Liability Clause:

Market management reserves the exclusive right to determine and modify site allocations, including but not limited to altering market layout and stall locations as deemed necessary.

Power supply is not guaranteed and will only be provided upon a case-by-case assessment based on availability and operational needs.

Stallholders are responsible for providing their own power if necessary. Market management assumes no responsibility for any damage to goods, equipment, or personal property occurring during the event. Furthermore, at certain locations, loading zones may not be available, and we do not cover parking fees, fines, or any associated costs incurred by stallholders.

22. Product & Equipment Damage

The Nash & Dash Markets shall not be held responsible or liable for any damage, loss, or defect of any products supplied, delivered, or sold during the course of the event or market. It is the responsibility of the vendor to ensure that their products are adequately protected, packaged, and insured against any potential damage or loss, including but not limited to damage caused by weather conditions, accidents, third-party actions, or mishandling.

These terms and conditions are designed to ensure a safe, enjoyable, and professional environment at The Nash & Dash Markets. By agreeing to these terms, vendors confirm their commitment to upholding the standards and policies of The Nash & Dash Markets.
